The site is owned by Air Traffic and Navigation Services Company Limited ("ATNS") of Private Bag x15, Kempton Park 1620 and the site is hosted and managed in the Republic of South Africa.

The user acknowledges that ATNS is a state owned and limited liability company in terms of Act no. 45 of 1993. The provisions of the Act and the Regulations pertaining thereto therefore bind ATNS

All content made available on this website and the manner in which it has been offered is protected by both national and international copyright laws and conventions, and all ownership, intellectual property rights and title vests with ATNS. The user may use the information retrieved from the website only for it's own personal use and is prohibited from altering, re-constructing, varying, reformatting, reproducing, modifying, translating, selling, retransmitting or otherwise making the information available in any manner to third parties and may not hold itself out as to be the owner of this information, unless it has obtained ATNS's prior written consent to do so.

Limitation of flight plan submission

The availability of file2fly services is limited to the briefing and submission of flight plans for pilots, foreign pilots residing in the country and foreign pilots departing a South African aerodrome.

The customization of the content provided, the responding to your requests for products and services, the improvement of services, statistical purposes and other kinds of processing and transmitting of personal and other data disclosed in your initial application for system access and/or in the course of using the file2fly system,

The comparison of these data with other data relating to myself, for purposes of present and future functioning of the file2fly system, as for instance system access initialization, Aeronautical Information and Meteorological Services, delivery, checking and forwarding of flight plans as well as charging of fees, and

The disclosure of such data by transmission to external data processors for the performance of these tasks.

Conditions for use of this website:

All materials, information, software, products and services included in or available through this web site are provided "as is" and "as available". ATNS does not warrant that the contents are accurate, reliable, complete, comprehensive, correct or up-to-date, that this web site will be available at any particular time or location, that any defects or errors will be corrected or that the content is free of viruses or other harmful components. Regulatory Environment

The user acknowledges that it is familiar with the Air Traffic and Navigation Services Act no. 45 of 1993 (Reference: Aviation Legislation in South Africa, Volume 1 Issued 9) and the regulations promulgated therewith.

The user acknowledges that it will at all times during the use of the website accede to the terms and conditions thereof.

The contents of the Regulations and the Act are hereby incorporated herein by reference.

Abuse of Web site

The user undertakes not to abuse the Pilot Self-Briefing portal by filing bogus flight plans or by interfering with, changing of or deleting flight plans filed by other users, or by doing anything else which may be detrimental to ATNS or its website users.

ATNS may suspend or terminate the user's access to the Pilot Self-Briefing portal should it determine that the user is not using the site in compliance with this agreement.

Conditions of Use

Only users who hold a South African Pilots license or have a postal/residential address in the Republic of South Africa may make use of the service.

The user undertakes to protect its username and password and will always keep it in a safe place.

ATNS shall at all times and for whatever reason, have the sole and exclusive right to suspend or terminate the service without any prior notification or giving any reason for such termination or suspension.

The Law Governing The Relationship

The conditions will be governed and construed in accordance with the laws of the Republic of South Africa.

Dispute Resolutions

All disputes arising as a result of the use of the site will, on the interpretation of these conditions or on any matter which in terms of the conditions requires agreement by the parties, be submitted to and decided by arbitration.

The arbitration will be held with only the parties and their representatives present at the offices of the Arbitration Foundation of Southern Africa, Sandton, Gauteng, South Africa. The arbitration will be governed by the rules of the Arbitration Foundation in terms of South African Law and will be heard by an arbitrator appointed by the Foundation.

Either party will be entitled to have the award made an order of Court of competent jurisdiction. The parties will keep the evidence in the arbitration proceedings and any order made by any arbitrator confidential unless otherwise contemplated. The arbitrator will have the power to give default judgment if any party fails to make submissions on due date and / or fails to appear at the arbitration.
